What is a Layby?
A layby is an agreement where products are set aside for you and paid for over time through two or more instalments.
The products remain the property of Our Past Times until the full purchase price has been paid. Goods will not be released until the layby has been paid in full.
Deposit Required
A minimum deposit of 25% of the total purchase price is required when a layby is established.
Layby Term
At Our Past Times, we understand that life sometimes gets in the way.
Unlike many retailers, we do not impose a fixed layby period. Customers may take as long as they need to complete their layby provided:
- Regular payments are being made; or
- The customer contacts us at least once each month if they are unable to make a payment.
We aim to be flexible and work with customers wherever possible.
Making Payments
Payments can be made:
- In-store during normal business hours; or
- By direct bank transfer.
Bank account details will be provided upon request.
When making a direct deposit, please use your surname or layby number as the payment reference where possible and notify us once payment has been made.
Payments will be credited to your layby once funds have been received and confirmed.
Adding Items to a Layby
Additional items may be added to an existing layby at the discretion of Our Past Times.
The layby balance will be adjusted accordingly.
Removing Items from a Layby
We understand that circumstances can change.
Customers may request that items be removed from a layby. Where the customer has paid at least the full value of a particular item, Our Past Times may, at its discretion, release that item and adjust the remaining layby balance.
Customer Cancellation
You may cancel your layby at any time before receiving the products.
Any store credit payable will be calculated after deduction of the applicable termination fee.
In keeping with Our Past Times’ Returns and Refunds Policy, cancellation of a layby does not entitle the customer to a cash refund.
Any remaining balance after deduction of the applicable termination fee will be issued as store credit for future purchases at Our Past Times.
Termination Fees
Special Order Items
Products ordered specifically at a customer’s request.
Termination Fee: 50% of the Recommended Retail Price (RRP).
Reduced or Clearance Items
Products sold at a discounted or clearance price.
Termination Fee: 25% of the marked selling price.
All Other Items
Termination Fee: 10% of the Recommended Retail Price (RRP).
Store credit will be calculated after deduction of the applicable termination fee.
Inactive Laybys
If no payment has been received and no contact has been made with Our Past Times for three (3) consecutive months:
- We will make a reasonable attempt to contact you.
- If no response is received, the layby may be cancelled.
- Any monies paid will be converted to store credit less any applicable termination fee.
Cancelled items will be returned to stock.
If you require additional time, simply contact us. We are happy to discuss your circumstances.
Store Credit
Any store credit issued under this policy:
- Is not redeemable for cash.
- May be used on any eligible product sold by Our Past Times.
- Will be recorded against the customer’s account.
- May be used towards future purchases, including new laybys.
Store credit issued under this policy does not affect your rights under the Australian Consumer Law.
Completion of Layby
Once the full purchase price has been paid:
- The layby will be finalised.
- A final receipt will be issued.
- The products may be collected by the customer.
Australian Consumer Law
Nothing in this policy excludes, restricts or modifies any rights or remedies available to consumers under the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure.
